General terms and conditions
These terms and conditions apply to the loyalty program of Lpdemo (hereinafter referred to as the ‘promotion) organised by Compass Group International B.V., established in Amsterdam, (hereinafter: ‘Compass’). Participants of the loyalty program (‘Participants’), due to their participation, accept the terms and conditions and the applicable terms and conditions of the partners, as mentioned on the website of dsap.magneds.com (the ‘Campaign websites’): This promotion runs from the 13th March 2017 to 7th of May 2017. This promotion is only valid in the Netherlands.
This promotion is open to individuals who are 16 or older and live in the Netherlands, with the exception of all suppliers of packaging, products or services (for example contracted packers) who are directly involved in any way(s) in this promotion.
If a participant is younger than 16 years, they must have consent of their legal guardian in order to participate in the promotion. Participants under the age of 13 years old are not allowed to join the loyalty program.
Creating an account for participation is free (except for the charges to use the internet).
Per person, per email address (and therefore per participant) only one account can be created and used.
Participation in the Promotion is only possible via the campaign websites and the application.
A participant may enter up to 10 unique codes per day to increase the balance of his/her account.
Compass reserves the right to disqualify and/or exclude from further participation each participant with immediate effect and without giving reasons if Compass suspects that the participant is in any way in breach of these terms and conditions, provides incomplete, inaccurate or misleading data, or data that is in violation of the law, or otherwise unlawfully acts against Compass or third parties.
Promotion mechanism and savings balance
This promotion aims to enable loyal customers to save up for discounts on products, subscriptions or activities of partners of Compass (the “Partners”). The participant can click on the campaign website or the app and create his/her account by entering a password and an email address. This requires the participant to make his/her contact details available. Through the created account a participant can save up for promotions and/or discounts to order promotional products from partners. The account is personal and (the balance) can not be transferred to others.
All vouchers carry a unique code of at least 11 characters. Each code can be entered only once and leads to an increase of the number of activated/saved stamps accumulated on the account. The codes can be entered during the promotional period. All imported digital stamps remain valid to the end of the campaign. After the deadline all digital stamps and full digital stamp cards will be removed and the participant can start saving digital stamps for the new promotion. The participant’s balance must be sufficient, as this can never be negative. An order will be rejected if there is an insufficient balance. The balance is not redeemable for cash or any other regular cash value.
Ordering and payment
A participant can order the desired promotional product via the campaign website. Compass has no involvement with and is in no way responsible or liable for (the implementation off) the order or its administration. The general (delivery) terms and conditions of the partner apply to this order and the settlement thereof, including delivery. Compass is in no way responsible for the availability of the various promotional items.
A participant pays the product he or she has ordered by automatically offsetting the balance on his or her account and supplement in regular euros to the relevant partner. Additional payment made to the partner, depending on the promotional product, is made via iDEAL. If the ordered product is available, the participant will receive an email confirmation of the order. The promotional product will be delivered to the participant in the manner of and within the period specified by the partner.
In some cases, a participant receives a voucher that represents a certain discount (“Voucher) which can be delivered to the partner to obtain a promotional product in combination with additional payment of a remaining amount. The voucher is personal, non transferable and has a unique (bar)code.
The voucher is sent once as a digital coupon to the email address of the participant.
Compass is not responsible or liable for loss, theft, forgery, (making) abuse and/or other misappropriation of the voucher, and settlement or payment of the balance to the original participant will never take place. If a participant makes abuse or commits fraud or an attempt to defraud the voucher, including trying to redeem the voucher through falsification, by cracking the barcode or otherwise technically bypass the (technical) security measurements, or resale of the voucher to a third party, Compass is entitled to immediately disclose the participant from participation of the promotion and to block the account. Compass is entitled to recover the full damage from the participant.
The voucher is under no circumstances exchangeable for cash or to exchange for other products than the promotional products or at other parties than the partner as indicated on the voucher. The voucher is valid and can be redeemed until the end of the period in which the partner participants in the promotion, after which the voucher loses its validity.
Supply and delivery
The delivery times of the partners, as indicated on the promotional websites, are indicative. No rights can be derived from this by the participants. PO Box address are excluded from delivery of products. Ordering and delivery of promotional items take place exclusively in the Netherlands. It is indicated with each promotional item if shipping costs should be paid. The shipping costs can vary by item and are indicated with the item.
The participant guarantees that the information provided by him are correct, up to date and complete. Contact details and other personal details that Compass receives in the context of this promotion will be included in its database and will be handled confidentially and in accordance with the Data Protection Act in the Netherlands. Compass will use the data from the participants for implementation of the promotion and communication thereof. Any other emails are only sent if the participant has authorised this.
Compass and its auxiliary persons or third parties are not responsible for any damage, direct and/or indirect, that arise from or is in any other way associated with (the implementation of) the promotion.
Compass is not liable for any direct or indirect damages that arise from, or is in any way associated with (i) products ordered by participants and delivered by the partners and makes no warranties with regard to these promotional products (including the timely and correct supply of these) and (ii) the (erroneous) transmission of vouchers.
More specifically, Compass and auxiliary persons or third parties are not liable for:
Any additional expense participants may make related to the participation to the promotion and/or the accepting and use of a promotional product.
Any damage, direct and/or indirect, arising from, or in any way associated with, disruptions in its network, computer hardware or software of any kind what so ever including possible problems or defects arising from use of the Promotional website or downloading components thereof.
Despite the constant care and attention paid to the composition of this website and the data contained therein, Compass can not guarantee the completeness, accuracy or timeliness of the data. Compass accepts no liability for any direct or indirect damages of any kind whatsoever arising from or in any way associated with the use of the website, software made available or (in)accessibility of the website.
Compass may terminate the promotion at any time, Compass will publish any termination as soon as possible on her promotional websites. In addition, Compass is commited to informing as many participants as possible, by the use of an email at least one week before the date of completion of the promotion, to notify them of the termination being at hand.
This collectable promotion is governed by Dutch law. Questions, comments and/or complaints regarding this promotion can be completed through the promotional websites to the customer service of Compass, by filling out the contact form on the promotional website, citing contact details.
Questions, comments and/or complaints regarding promotional product that have been ordered from partners, should be addressed and submitted to the partners. The contact form for the relevant partner can be used through the promotional website.
